Indian Government Keeps Future AI Legislation Options Open

As the Centre establishes a committee and a high-level ministerial body to shape India’s artificial intelligence (AI) policy, an official from the Ministry of Electronics and Information Technology (MeitY) stated that the government has not dismissed the possibility of a separate legal framework for AI in the future. Currently, the government believes dedicated legislation is unnecessary, as AI is still in an early, innovation-driven phase in the country.

MeitY has announced the formation of two committees to advise on AI governance policy development and coordination. The Technology and Policy Expert Committee (TPEC) was established on April 18 to guide the AI Governance and Economic Group (AIGEG), formed on April 16. The official noted that these committees will only advise the government and do not possess independent statutory authority.

India does not yet have a dedicated AI law, unlike jurisdictions such as the EU AI Act. Some aspects of AI, particularly AI-generated content, are addressed under existing IT rules. The formation of these committees formalizes recommendations from India’s AI Governance Guidelines released last November and the Economic Survey published in January this year.
